International conference was held to share experiences in constitutional and administrative procedure
International scientific-practical conference on “Constitutional and Administrative Procedure: International Experience and National Practice” was held un 2nd May 2023 in cooperation with colleagues of the National University of J. F. Chernivtsi, the Yaroslav the Wise National Law University and Zaporizhzhia National University.
Assoc. Prof. Dr. Haroldas Šinkūnas, Dean of the VU Law Faculty, welcomed the conference and rejoiced the progress made in the harmonisation of Ukrainian law with the requirements of European Union law in the areas of constitutional and administrative law. Professor Dr. Jurgita Paužaitė-Kulvinskienė, Vice-Dean of the Vu Law Faculty, Head of the Center of Administrative Law and Administrative Justice, evaluated the content of the procedural rights enshrined in Ukraine’s new Law on Administrative Procedures and their compliance with the principle of responsible governance enshrined in Article 41 of the Charter of Fundamental Rights of the EU.
The remote event discussed relevant issues such as: what criteria should be used by a court when assessing the legality of an administrative act, and is the Ukrainian legislator consistent in this area? What is the content of an “administrative act”? Another part of the conference was devoted to the institution of the constitutional complaint and the exercise of the competence of the Constitutional Court of Ukraine during martial law, and what are the procedural guarantees provided by Article 6 of the ECHR as a basis for the formation of Ukrainian constitutional law in the field of the protection of individual rights.
