On the 17th of June 2024, at 12:00, PhD student Miranda Borusevičiūtė will defend her dissertation on the topic “The Constitutional Council for the Judiciary in Lithuania: Legal Challenges”.

Annotation

The dissertation comprehensively examines a special institution of judges, provided for in Paragraph 5 of Article 112 of the Constitution, and reveals the prospects the said institution of judges has. The dissertation attempts to discern the constitutional meaning of a special institution of judges, provided for in Paragraph 5 of Article 112 of the Constitution, and to assess which institution the legislature has chosen to provide for by means of a law. The dissertation argues that by selecting the model of self-governance of the judiciary and by regulating the area of the formation of the corps of judges, the legislature has not accurately assessed the end for which the Judicial Council, as a special institution of judges, provided for in Paragraph 5 of Article 112 of the Constitution, must be constituted and its exact constitutional powers. By the established model of the Judicial Council, the legislature has not only failed to ensure the effectiveness of the self-governance of the judiciary but also has departed from the constitutional meaning of a special institution of judges, provided for in Paragraph 5 of Article 112 of the Constitution. The thesis proposes a solution that would allow the reform of the current Judicial Council without amending the Constitution.
